Only one person was inside the Chevrolet Impala at the front of the April 9 chain-reaction crash that ended with former Saints defensive end Will Smith being shot to death on a Lower Garden District street, New Orleans police said Wednesday (May 4).

Authorities told the public shortly after the fatal shooting that two people, friends of Smith and his wife Racquel, were inside the Impala as it traveled along Sophie Wright Place. And an NOPD traffic crash report obtained by NOLA.com | The Times-Picayune identifies both the Impala's driver and a passenger.

But NOPD spokesman Tyler Gamble, responding Tuesday to questions about the crash report, said the woman identified as the Impala's passenger was actually riding in Smith's SUV with Racquel Smith and one other man – who is not mentioned at all in the crash report. The SUV was rear-ended by an orange Hummer H2 driven by Cardell Hayes, the man charged with murdering Smith and wounding his wife.
The man identified in the report as the Impala's driver was that vehicle's sole occupant, Gamble said.

The NOPD crash report includes more than one factual error, Gamble said. The officer's assessment of vehicle damage does not account for Smith's Mercedes SUV having its rear windshield shattered, as was stated by Smith family attorney Peter Thomson four days after the shooting.

Instead, the report states that each of the three vehicles sustained "very minor" bumper damage.

Responsibility for the investigation had largely shifted to homicide detectives by the time the traffic officer was preparing the crash report, Gamble said in his explanation of the report's errors. He also said most witnesses or involved parties were either being questioned by detectives or were at the hospital with police and Racquel Smith. As such, Gamble said the traffic reporting officer was limited in the information she could gather at the somewhat chaotic scene.

Public records indicate that the Impala's driver and the woman mistakenly listed as its passenger are siblings. NOLA.com | The Times-Picayune is not naming either person because the news organization generally does not identify crime victims or witnesses without first speaking with them. Neither could be reached for immediate comment.

An Orleans Parish grand jury last week indicted Hayes, 28, on charges of second-degree murder, attempted second-degree murder and criminal damage to property. Hayes has pleaded not guilty. His attorneys, John Fuller and Jay Daniels, have criticized the NOPD investigation and have repeatedly implied that Hayes shot Smith in self defense.
