It has always been political, it's just the nature of the SCOTUS. The Republicans just became really fukking dirty, as we should expect, but they did it at a smart time, and were able to shove in too many justices under a very unstable individual, Trump, so now it's clear the justices are just doing what benefits conservatism because no Republican had an issue voting in any conservative justices that were put before them, thus you get literal agents for conservatism.

A large majority of the votes since 5-4 have been bad, the 6-3 votes, you don't even want to see those. In truth, you don't want to see what that current makeup what rule on issues most think are already settled in America.

Has it always been like this? The supreme court I mean. Has it always been so political? It means the institution is completely broken. A court which regulates administrative law is supposed to be apolitical. It's supposed to stop politicians from rigging the system in their favour, not be an active ally in doing that. The whole idea of checks and balances in a constitution relies on the checks and balances constantly fighting against each other, not working together

The mistake was done with Dems voting in Hillary over Bernie.

Bernie had huge support in the rust belt states. He was going to inherent all of those Obama votes and instead they voted in a corporatist in Hillary.

It was codified into law in 1965 but recent supreme Court decisions have been ruling parts of it unconstitutional or no longer needed.

Yeah but politics is politics. You can expect that people will come along with different ideas about how to govern. I'm sure when the constitution was first drafted, the authors envisioned the possibility of a Trump or Reagan like character taking office. But they designed all the checks and balances to limit how much those types of men could do in office. They must have never imagined that the checks and balances would be insufficient to stop them.

But now that the checks and balances are failing, it's a very bad situation. The whole constitution is flawed if something like this happens, and it needs to be rewritten from scratch. Once you expose a weakness in the constitution, it will be exploited forever. So from now on every time a politician gets the chance to pack the Supreme Court with his creatures, he'll do it. The only move is to tear it up and start all over again, this time patching that exploit.
