Once the aggressor saw the gun he walked away to retreat.

Then he was shot.

In every state you go to jail for shooting a person who's running away...

It looked like the aggressors wife was grabbing him and he was pushing her off or trying to get her to go back inside..
Who knows if the shooter felt the man would come back.

I understand what you're saying because A case can be made that the deceased was walking away with his back turned.

Dude was probably already dead at that point. If they prove the final shot was post mortem there will be no claiming he fear for his life from a dead body.

The shooter is not a doctor.
He's shooting and doesn't know when someone is truly "incapacitated". He's gonna keep shooting.

The kid fell in his direction and was still moving, he could have thought he would still attack him.

In the video the son is running away cause it looks like he assumes the shooter is just shooting the dad.

He was running past the shooter to go down the stairs and the shooter shot him along the way
