Question for the Coli legal analyst.
Is there any way Ave can use he clapped back as a defense without snitching on the person who started the altercation?
All of this shyt is contingent upon them FINDING the shooter.
If they don't find the shooter, but can confirm that Troy didn't shoot his man & was retaliating, then he can use the defense without implicating anyone.
Troy's in a tough position period. No one said it's gonna be easy for him to dig himself out, but it's definitely feasible.
On the other hand, if they find the shooter (with or without Troy's help of course), street politics, the definition of snitching, etc will all come into play and it'll get messy. Troy's fukked either way, whether they find the shooter or not, it'll still be a tough case to fight, but BEATING THE ATTEMPTED MURDER CHARGE is definitely, definitely possible. Especially with it being so early in the case, and people talking about a 2nd shooter so early, leading to the police investigating that.
I don't believe Troy was the only shooter, however, EVEN IF HE WAS, he hasn't made any real missteps legally yet. Let's say, for the sake of the Coli, that Troy shot Banga, but there's no proof (yet). HIS BEST DEFENSE, whether he shot him or not, is to say that he shot in retaliation, after struggling over a gun. Yes, keeping quiet, you'd THINK is the smart thing to do, but with celebrities, public personas, rap personas, real personas, and money all coming into play, PUBLIC OPINION and JURY SELECTION (jurors aren't supposed to be aware of any case details, but in today's world it's impossible)... staying QUIET when the WHOLE WORLD is tweeting that your client shot his own bodyguard, is NOT the move.
And I'm no Coli legal expert, most of this is common sense, basic, surface level knowledge of the Constitution, US law, and court case proceedings. You nikkas is just nerds who guess, assuming everybody else is like you. Clown ass nikkas should've paid attention in class or picked up a book at some point. You so knowledgable on everything else Hip-Hop, but when it comes to the law, the shyt half you nikkas sit on here and bytch about, you clueless. Then when a nikka in a position such as myself drop knowledge to enrich your mind or for you to put to use if you or someone you know ever need it, you pop shyt.
I'ma just say this, and this will be my last post in this thread. This thread was never about me or trying to make it about myself. I dropped some knowledge, and a fukk nikka who eventually backed down in my PMs, started commenting on MY legal situation, hence the back & forth. nikka I've had detectives lay on my house, my friends, everybody I knew, for info. Been stopped by them, started conducting MY own investigation of THEIR whereabouts & families, and the next time I was pulled over by them, I let them know everything I knew. And made a threat to their families so subtle but vivid, when they tried to charge me for threatening the life of an officer & obstructing an investigation, I SPANKED the case. Straight embarrassed cacs in court, when THEY thought they had me dead to rights. I've beaten & lost others too.
Had these lame ass cacs playing my old ass music in court (which was anti-police) and STILL beat the case. Not because of the lawyer, but because they couldn't say I violated a particular legal statute in Virginia. The way I made the threat and did my own investigating got my point across without actually breaking the law. I knew this as I said it to him. All this transpired in 2006, I was 19.
With that being said, my current case, I'm completely innocent. Got a long track record though so I hired the best lawyer in the city I'm in court at. 15k to retain, 25k for the full fee. And son is a BEAST. With that being said, it was quite telling to me that when I revealed MY defense to him, HE followed suit & jumped on board, full force. Say less.
