If you read the full article the grandmother did take the girl but the mother called the police and since the grandmother did not have legal custody the police made her give the girl back to her mother. Then the grandmother tried calling CPS and telling the police about the abuse to get her out of her mothers care but they were ignored, hence the wrongful death lawsuit.
