what part of conservative pre-Federalist society judges on the bench for much of that time being much more flexible that you don't understand?
This is the part of these discussions that frustrate me in here. It's the absence of understanding nuance. The republican judges NOW are originalist judges who interpret the Constitution based on its original meaning at the time it was written and ratified. Originalist judges believe that the Constitution’s meaning should be understood in the context of what the words and provisions meant to the people who drafted and adopted them in the 18th century. Do you know what judges thought about Black people in the 18th century? Abortion in the 18th century? Voting in the 18th century?

Why don't you guys see how clearly different these new republican judges are compared to past ones on the bench over the last 51 years? "Republicans have had the majority the past 51 years".....that's a fukking answer?
