He said tory was still in the car when the girls were fighting and when Kelsey went to go get the gun. He literally said he saw her get it from the car, then a flash/noise that he at first thought was fireworks. That’s how he was sure the first shots came from the girls. The shots went pop pop pop pause pop pop (I’m not sure how it was recorded). But Kelsey shot the first shots, Tory came around the car and took the gun (I guess he grabbed at it during Kelsey third shot and the pause was their struggle over the gun. That’d mean 2 shots left.
Where exactly did you read that the witness saw Kelsey retreat to the car and grab a gun? The witness clarified during the trial that he never actually saw the gun, and originally just thought he was looking at fireworks. I haven't seen anything about him saying one of the women went back to the car during the fight.
He said tory was in the car during the altercation, then he said he might have already been outside of the car when he first saw everything. He said it looked like the gunshot came from inside the car, but the said they came from closer to the woman. He said Kelsey fired the first shot and tory fired the rest, during the recording there were 3 consecutive shots before a pause, i dont think it was said how long the pause was.
There is no telling when the fragments got into her foot. Kelsey in her second testimony claimed megan was froze until the shooting sound stopped, that doesn’t mean Tory bullets he shot in the air fragments popped her when Kelsey was the one who was specifically targeting Megan and shot downward. Megan was kicking her during their fight so that’s probably why she aimed towards her feet.
The witness also clarified that he didn't mean that tory was shooting directly in the air like you'd do with warning shots, he explained that Tory was shooting wildly in all directions but not aiming at anything in general. He also never said anything about the direction Kelsey shot in.
The point is people are still debating bc there was not enough info/evidence. It was not a solid or proper case and should’ve been thoroughly investigated instead of blaming whoever. I believe Kelsey did it but they didn’t even look into her doing it. Sad but karma
I really want them to go back and dna test all 3 of them. Find who own the gun. Also I’d like to hear the driver’s story. I want to hear what Kylie had to say too bc I believe she told them to get the fck out bc Megan started a fight
I think there's enough evidence to make a strong case, especially when Tory and his team weren't willing to directly put the blame on kelsey when every other person involved was pointing at Tory.
Prosecution dropped the ball a few times but it ultimately didn't matter because Tory's legal defense was awful.
