No one was shot though. Being hit by bullet fragments in the foot and getting full on shot is two different things.
In reality many people under the influence of alcohol if armed would attempt to break up a scuffle by discharging their firearm. It’s not a smart thing to do obviously but it’s not something I feel anyone should go to prison over.
I’m okay with him being found guilty on possession and for reckless discharge but that assault charge is bullshyt. There was no motive for malicious assault.
