The witness never said Tory shot in the air he said Tory fired four to five shots everywhere.

they said his dna on the gun was inconclusive. but there was male dna on it which could conceivably be any males. 2 not sure if a whole or partial projectile was found that could be match to the barrel print of that gun specifically. but yeah i get what you mean.

No he didn’t.

The confusion is he said “in the air” in the initial interview. But in court it’s the defense that emphasized that term which he confirmed he said.

Once the prosecution was able to talk to him he clarified he didn’t literally mean straight in the air but shooting all over the place.
