It's not all on Batman. Most of the blame can be put on Gotham's judicial system. There was an episode on Batman TAS that addressed this. Joker and others stated that all we got to do is fake sanity, and we will be released from Arkham. Rinse and repeat. Gotham's authorities knows this but doesn't change the laws so they won't stay locked up forever or executed.
