A bill that has cleared a Florida House subcommittee would make it a crime to post nude photos on the web attached with personal identification information without the subject's consent.

Rep. Tom Goodson, R-Titusville, said Wednesday his bill aims to crack down on "revenge porn." He says the issue was brought to his attention by the Brevard County sheriff, who told him of an increasing number of complaints.

The measure (HB 787) would create a felony offense for the non-consensual posting of nude photos or videos on websites along with the subject's personal identification information. The penalty would be harsher if the victim is younger than 16.

Imagine a woman does a Google search on her own name and up comes a page featuring a naked photo that she sent to an ex-boyfriend. There are links to her Facebook, Twitter and LinkedIn account. In the comment thread, anonymous trolls critique every inch of her body. Perhaps her home phone number and address are also included. Say she contacts the local police in tears, only to be told that the post is perfectly legal — or worse, that “boys will be boys.”

This is becoming an increasingly common scenario, activists say, given the proliferation of “revenge porn” and the legal system’s failure to catch up with it.

A new bill in Florida is aiming to remedy that: It would make it a felony to publish online nude photos or videos of a person without their permission and along with identifying information. At the same time, activists around the country are petitioning for both state and federal laws to criminalize what they call “non-consensual porn.” A recent class action lawsuit filed by more than 20 women in Texas against revenge porn site Texxxan.com along with its host GoDaddy has only turned the heat up on the issue.

Stupid. A picture is the property of the person who owns it, not the person whose in the picture. This would get thrown out if it ever went to Supreme Court. If u don't copy write your image, it's not your property.

Actually a person has a copyright on their property as soon as they create it. It may not be a legal copyright, but it's their property.

So this is more like if a person takes a nude pic of you and has it in their possession, they can redistribute it as much as they want.

If you take the photo and give it to the person, then it's still your property.

I dunno how this would work under that Florida law but I assume it would be similar to the copyright laws.

I only know this shyt bc my brother is an artist.

I'm pretty sure the basis behind the law is not the question of ownership of images, and more of the question of harassment.

Look up waivers in Contract Law.

They may own the property but waivers must be signed by all parties involved before property can be distributed.

So you're saying if I take pictures of the Empire State Building with my camera and distribute them, the owner of the Empire State Building could easily send me a cease and desist order?
