Irritated that I just ran out of gas, anxious to get to a gas station so I can get the hell out of there while trying to clock threats from everywhere. Looking for cars coming from both directions. Looking for wildlife. Your head would be on a swivel. So let’s say he did see him texting, that would mean the car was most likely heading toward him, right? If you can pick up someone texting at speed coming towards you, why couldn’t they get out of the way?

Thats your personal opinion. Will the judge and prosecutors think it was justifiable? How would I know. He will obviously charged with a crime because he did something illegal, but every part of the legal system has discretion built into it. If your emotions cloud your judgement there is no controlling yourself. If his anger was justified then his action were to it's that simple.
