I have a friend who killed someone drunk driving. He wasnt charged until 3 months later, after he got discharged from the hospital.

My point is that a DA might not bring charges until the investigation yields enough evidence for a solid conviction. And this isnt factoring that both of them have high powered legal teams that may be working the case as well, trying to cut deals.
