Honestly, I think he will beat it despite the shooting in the back shyt.

I think the law is if someone is running away and you shoot them in the back it’s murder. I had a homie do this to a burglar once but he had rubber rounds. So homie think he got shot/put down but he was still alive. It’s the reason why my first few rounds are always rubber in home defense.
