prosecutors/DA's are political positions. they have zero appetite to go hard in these kinds of cases. People who think he's cooked are making very technical legal arguments. But the decision to actually charge someone is usually a political one. Look at the responses in this thread. People might have some sympathy for the brothers bc of the position they were put in, but no one is actively hoping he gets put away.

There will be a determination as to whether this case rises to a level that they are willing to spend taxpayer dollars to prosecute something that'll be acquitted. I would even argue that there is nothing wrong with that type of decision making by a prosecution office.

The reason why it's important to discuss this in it's most technical legal way is to inform and education. Based on the letter of the law, NO, we can not say he can get off without repercussions. He can still get arrested, arraigned, indicted and sweat buckets until the prosecution motions to dismiss their case and/or a trial ends in an acquittal.

That being said, I just want my fellow Coli brehs to understand that what we see here can still be prosecuted. Luckily, there is footage. But, if there was no footage and it was the statement of the home owner vs. the statement of the brother and the autopsy report showing entrance wounds in the back and the position of the deceased OUTSIDE of the home? That's deep shyt.

It would be fukked up for me to contribute to this thread and not bring forth these points and have a nikka jammed up thinking they would still be in the right by discharging their weapon at a target running AWAY from them OUT of their domicile.

One interesting thing about these scenarios nowadays is how the prevalence of doorbell cameras has changed the game. I bet quite a few people besides the man who posted the video gave footage of the incident....shooter includes.
