LEGAL ADVICE: I got hit by a car.

Coli fam I need legal advice on how to sue someone who hit me with their car.

I was walking through a crosswalk with the right to cross sign and a car ran a red light and turned and hit me. They were going about 15 mph, hit me, I flew about 5 feet airborne.

I couldn’t feel my legs for about 15 seconds which was scary and it took like a full minute for someone to come help me. The driver NEVER even got out the car to ask if I was ok or anything!!!

Anyway ambulance comes and they basically force me to the hospital because they just know something’s wrong. Spent the whole day in the hospital, came out with no broken bones which even the doctor was surprised, and I just have a contusion on my shoulder. They have me some oxy that I’m gonna flip so that’s an easy $200 but I want my real money.

I don’t know if I spoke to a cop or not. Someone (assuming police) came in the ambulance with me and gave me the drivers info. I never got a police report. And truthfully it happened so fast idk even know what the person looked like who was driving.

What are my next steps? Obviously call a lawyer Monday but do I need to call the police and either get my police report or file one? Do I call the driver directly? I wasn’t driving but do I call my insurance? I’ve never sued anyone and any advice would help

I’m really messed up, like took 5 minutes to get out of bed messed up, and my lower back is gone I can’t lift a thing.

No permanent injuries but the route I was gonna take was headaches and emotional distress. I get really bad headaches already so there’s no doubt I can say this accident has/will make them worse.

And my petty angle I think I might use is emotional distress. I got in a really bad accident in car a few years ago and I hate driving and sometimes can’t. Think I might say this accident has “stopped my ability to walk as a pedestrian without stress of being hit by a vehicle”

Right. My back and leg is all bad right now but god willing not permanent. That’s why it’s a long shot but I’m gonna try to build some emotional distress case if I can.

No real injury, you probably should just settle it on your own, unless you wanna give up 33%. Police report will probably be online in like two weeks. Go back to the doctor, and say your back is bothering you, and go do a couple of weeks of physical therapy.

If you can take some time off from work. Your medical bills I’m guessing will be around 10k or so with with the ER and ambulance. So they’ll probably try to give you a 1.5 for the multiplier…try to get 5k out of it. But this is assuming you still don’t have any real injuries… just file the claim against them, and just tell the adjuster you’ll talk when you’re done treating.

They’re probably going to try to offer you like $1000 to close it, don’t take it, just make sure you’re completely healed first.

get the driver and/or owner's insurance info, get a police report (or file one if they never came to the scene), call your own insurance company

if the driver and owner don't have insurance i wouldn't bother, the number one rule of lawsuits is to never sue poor people
