Kawhi issues federal lawsuit vs Nike + Jordan Brand for shoe logo

I wish him luck, but he's on record saying he didn't create it, just rough drafted it. I don't see how he can win when he allowed Nike to trademark it while he was with them and didn't oppose then. His uncle whiffed.

Did you read the article he gave them permission to use it in certain areas, not other areas a contractual agreement. Kawhi has a damn good case if you ask me.

It happens with comic book properties all of the time. Nike has a strong defense. Essentially, it was designed for Nike. He brainstormed an idea and gave it to Nike to use. I think his problem would specifically be if he didn't have it established BEFORE signing with Nike. But he already admits that he gave them a rough idea and they took it to where he couldn't believe. That works against him. It doesn't matter what he says now, because it is owned by Nike. "I don't want them to use it for X, Y & Z" but he is no longer with Nike for it to even matter, and it's their property. If he didn't legally own it prior to giving it to them, it's not his to take. His best bet would be that there is an expiration or abandonment clause in the contract.

Nike deals with this all of the time. They're a corporation that specializes in branding. If that was me, I would've did it myself, (OR hired someone to do it for me), established it as my property then taken it wherever I went. They would have to rent it off me, or come up with something on their own. Mine would be separate from anything I establish with a mega-Corp. He probably never figured he'd leave Nike so soon, but people never really think that far ahead.

Could Nike give it to him out of good faith? Sure. More than likely, they'll make him pay a hefty price for it. And you know they're gonna eventually use the sneaker design anyway, no matter who it's given too.

Good luck trying to win. Uphill battle like a mufukka. shyt developed while you work for and/or under contract with a company is theirs usually by law. Even if you develop and create it on the side top.

Logo is aight :francis: He should just have another version of the hand under new balance. At the end of the day nike won't be able to get his cosign on using the old logo.

I read the complaint. It looks like a strong case for Kahwhi and that Nike has no claim to the logo.

He mentioned in the complaint document that he told them to go after the third parry knocks off and he said they said it wasn't their business. Meaning they don't own it! They did exactly what he and they agreed upon which is they were using the logo as per permission stated for the agreement. In the documents, they also referred to it as his logo. Like I said he has a strong case.

In the complaint, he is asking for clarification of the rights to the logo, not a settlement.

Trademarks don't need to be registered and are there as legal concepts to prevent confusion in the marketplace

Nike will never use the logo again because despite having a copyright to the ART and DESIGN of the logo they do not have any rights to the identity that the logo is associated with (Kawhi) and thus would be using it to MISLEAD CUSTOMERS about the brand identity being sold.

Now will Kawhi get to use the exact logo? We will see. I personally think he wins this one handily and the judge might punk Nike for punitives. But Nike are snakes so we'll see.

Currently Nike has the copy on the design they submitted. Kawhi might not be able to get it back, but to the point of the poster above he could basically take the exact same Klaw logo and change the color/one font and be fine.

Logo IP law is complicated... @String Bell what they say about this at prestigious law schools breh?

Nah. If you read the lawsuit they copyrighted it without his permission and throughout the process of working with him they admitted in writing that they knew it was his property. They acted like a licensee, but then snaked around him to copyright it. They'll probably just agree to hand it over. Someone in Nike was being too much of a snake without realizing they already gave away their claim to it being their copyright. Most people would just let Nike rock.
