They acted like a licensee, but then snaked around him to copyright it. They'll probably just agree to hand it over. I read the CNN/MSNBC articles, and I still don't see a change in my viewpoint. Whether or not they snaked him is a different argument, but he never trademarked it, while allowing Nike to do what they do.

Nike won't lose this, but they can just let him have it or settle because of bad publicity.

I read the lawsuit. The reason I say he may be fukked is because NIKE is a multi billion dollar brand that can drag out court proceedings until the person/entity who filed the suit can no longer justify the money being spent especially since they will 100% try to use his words against him. This is the exact reason why Balmer/the Clippers attempted to buy the logo. It might be too much for one man to fight in court, he's probably better off trying to work a deal out with them that gives them a percentage of the profits made from the logo, although I don't know how that would work out since he is now signed with NB.

The question is would he really be "getting over" on them? They can't do anything with that logo right now. At best maybe they can use it when he retires and re-release the shoe but without his name. And college players or pros looking for a new sneaker deal could be turned off if they feel Nike is doing Kawhi wrong. Is it worth it?

Trademarks don't need to be registered and are there as legal concepts to prevent confusion in the marketplace

Nike will never use the logo again because despite having a copyright to the ART and DESIGN of the logo they do not have any rights to the identity that the logo is associated with (Kawhi) and thus would be using it to MISLEAD CUSTOMERS about the brand identity being sold.

Now will Kawhi get to use the exact logo? We will see. I personally think he wins this one handily and the judge might punk Nike for punitives. But Nike are snakes so we'll see.

Currently Nike has the copy on the design they submitted. Kawhi might not be able to get it back, but to the point of the poster above he could basically take the exact same Klaw logo and change the color/one font and be fine.

I read the complaint. It looks like a strong case for Kahwhi and that Nike has no claim to the logo.

He mentioned in the complaint document that he told them to go after the third parry knocks off and he said they said it wasn't their business. Meaning they don't own it! They did exactly what he and they agreed upon which is they were using the logo as per permission stated for the agreement. In the documents, they also referred to it as his logo. Like I said he has a strong case.

In the complaint, he is asking for clarification of the rights to the logo, not a settlement.

This right here is the most important part. If they truly told him he has to pursue legal action against people using the logo then he has a strong case. Also they refer to the logo as Kawhi's and Kawhi has used the logo to advertise camps with no association with Nike. Essentially it seems like Nike was a work for -hire commissioned to create a logo for him. But if that's the case then can't Nike ask for compensation in some form for creating the logo?

Unbeknownst to Leonard and without his consent, Nike filed an application for copyright registration of his logo and falsely represented in the application that Nike had authored the logo.

If Leonard can show he had drawings of the logo in 2011 and then Nike files that application in 2013 claiming that Nike authored it themselves than it's payday for Kawhi.
