JL movie wouldn't need to involve Nolan's Batman universe.
They're starting fresh. They're free to take on whatever tone they want.
Even if the Nolan flicks were considered part of the unified DC movie universe and they used JGL as Batman it wouldn't mean they had to make the Justice League movie using the same tone as the Bat movies.
Most Batman comics have an entirely different tone than the JLA comics and Batman acts differently in the team setting than in his own books.
It's not just about the tone...It's about what the character is actually capable of doing.
Nolan's Batman couldn't hang with characters like Superman, Wonder Woman, Green Lantern, Aquaman, of Flash. He couldn't hang with them, let alone get the better of them. He'd ultimately end up being also ran.
The same could be said for how Batman is written in his own comic as being very street level yet is still a credible threat in the JLA.
I mean dude has issues with the Penguin and Riddler in his own book yet is instrumental in taking out Darkseid or Amazo in JLA comics.
The character is different depending on the situation. And nothing is written in stone that moving forward Batman can't have more gadgets and stuff since Nolan would not be part of any future Batman movies.
The obvious move should be to let JGL play Batman in the JLA and Batman reboot. If DC was on their game the would have had JGL make a cameo in Man of Steel somehow. The Avengers really flipped the script on the comic book movie game. Marvel is moving into phase two, DC can't even get their blueprint together.
