This is an interesting case. I think they had a morality clause in the licensing agreement and they are arguing that it was not used for a moral purpose (misogyny, cursing etc) and thus is a violation of the agreement.
The music moguls have been accused of misusing the melody of an Egyptian love ballad from the 1950s, Khosara Khosara, in the 1999 hit single Big Pimpin'.
On the opening day of the trial, lawyers said Timbaland had used elements of Baligh Hamdi's song thinking it was royalty-free - but later paid $100,000 (£65,140) to EMI Music Arabia for the licence.
Mr Hamdi's family allege the pair should have asked for their permission too, as Big Pimpin' contains "vulgar" and "risque" lyrics.
They claim Jay-Z and Timbaland did not contact them on purpose because the duo knew the family would reject the request.
