I think he should be convicted of manslaughter and maybe even a lesser degree of murder by the letter of the law. But people of all different races, male and female who I talk to are extremely sympathetic to Penny. As best I can tell, people are sick of being accosted by the mentally ill and dgaf about them.

Looking into it, you are right it it was at least 3 minutes of a chokehold. They got to prove he was trained to not do 3 minutes of a chokehold and that he didn’t let go until after Neely stopped breathing.

I think the witnesses aren’t all automatically backing Penny.

Did the journalist witness (guy who was filming) not say he restrained him for 15 minutes? I could be wrong but I thought that was what he stated?

There's another video with someone stepping onto the train and telling Penny to let him go because he was going to kill him. He also told him to let go because Neely had defecated himself. The chokehold was held for 45 seconds after Neely went limp.

A conviction should be a layup.
