They don't lose the seats until January. Even if they lose their elections, those Senators can stay in place and vote in the justice in November or December.

It would probably the most openly shady political move in our lifetimes, but 100% McConnell will do it.

There’s a rule you can be seated for a special election once votes are certified by the state. So November.
