A pair of unanimous Supreme Court rulings have been making federal prosecutors’ jobs more difficult in anti-corruption cases, and one of the first beneficiaries of these precedents may be Sam Bankman-Fried, the most hated man in cryptocurrency.

On Friday, Bankman-Fried’s attorneys argued that five of the charges against their client might now be on shaky ground in the wake of the holding in U.S. v. Ciminelli, a decision authored by Justice Clarence Thomas. That ruling voided the corruption conviction of Buffalo-based contractor Louis Ciminelli, who was involved in a major development project ballyhooed by former New York Gov. Andrew Cuomo (D).

In the process, Thomas — with unanimous agreement from his colleagues — voided the so-called “right-to-control” theory of fraud prosecution holding that someone can be found guilty of wire fraud for scheming to deprive the victim of “potentially valuable economic information” needed for “discretionary economic decisions.”

His opinion, however, found that the “federal fraud statutes criminalize only schemes to deprive people of traditional property interests.”

Time and good fortune seems to be on Bankman’s side. Scamming ppl using crypto looks like a green light since it’s inherently risky and has no formal regulation except for tax purposes.

seems like the prosecutors fukked up and will need the Bahamas to consent to those 5 charges.

Bankman-Fried was extradited from the Bahamas on eight criminal charges stemming from the collapse of FTX, the crypto-exchange he founded. He has argued the U.S. government breached its extradition treaty with the Bahamas by filing additional charges against him months later, including bank fraud and an allegation he paid a $40 million bribe to the Chinese government to unfreeze a trading account.

"We think dismissal of those counts would be the better outcome," defense attorney Marc Cohen said.

Do Kwon, the cryptocurrency boss behind the $40bn (£31.3bn) collapse of the terraUSD and Luna tokens, has been sentenced to four months of jail in Montenegro.

Mr Kwon was found guilty of forging official documents.

He was arrested in March as he tried to board a flight to Dubai at Podgorica Airport, in the country's capital.

Mr Kwon also faces charges in the US and South Korea over the collapse of the two digital tokens last year.

The former finance officer of Mr Kwon's company Terraform Labs, Han Chang-joon, was also sentenced to four months in prison after being found guilty of the same charges.

Mr Kwon and Mr Han pleaded not guilty at their first court hearing in May.

The sentences will include the time that Mr Kwon and Mr Han have already spent in detention after being arrested in March, the court said in a statement.

They will also be able to appeal the verdict within eight days of receiving written notification from the court.
In February, US regulators charged Mr Kwon and his company Terraform Labs with "orchestrating a multi-billion dollar crypto asset securities fraud".

"We allege that Terraform and Do Kwon failed to provide the public with full, fair, and truthful disclosure as required for a host of crypto asset securities, most notably for Luna and TerraUSD," US Securities and Exchange Commission (SEC) chairman Gary Gensler said in a statement.

Last year, a South Korean court issued arrest warrants for Mr Kwon and five other individuals connected to the case.
Prosecutors said they believed that Terraform Labs, which is registered in Singapore, had violated capital market rules.

Montenegro does not have extradition treaties with the US or South Korea.

The collapse of the terraUSD stablecoin and the associated Luna token rocked cryptocurrency markets in May 2022.
