He could’ve backed off and waited for the cops but he wanted to tussle with a man with a gun and paid the price
I see both sides of this equation. Yeah dude should have taken the gun seriously but also when dude shot at him, THAT was not a warning shot. He tried to hit him, and at that point the one that died saw dude get some distance to hit him again and his fight or flight response was to fight. Keep in mind the shooter was in the yard by this time and the unarmed person was on the porch, so unless he literally ran off the porch he was going to die after that 1st shot missed. I'm convinced of it that that man was going to die unless he let the shooter strip him of his manhood. He even said the cops were on the way and dude didn't care. At that point they should have left that man on the porch. The ex-wife ain't shyt, the son was probably inside the whole time and the stepfather was going to kill that man eventually if not that day. If he was really trying to see his son and ol girl didn't have him there when clearly he was supposed to have him at that particular time then he had every right to speak his mind he even called the police like he was supposed to but she had no intentions of letting him see that kid for whatever reason. Since it happened on their porch then he may get away with it but unless they discussed a different location he had every right to be there. He even said that if he(the kid) wasn't going to be there knowing he was coming she should have told him. She was playing games plain and simple. He could have walked away and still be alive but once that gun came out, it was over. From that point on the step-dad would have had 2 kids the son and the dad. And pretty much every visit would be like some kinda wild west duel with pistols in holsters until the kid came out. The shooter knew that was gonna be the father's last visit.
