Justice Clarence Thomas, the author of the majority opinion in the 2022 decision, New York State Rifle & Pistol Association v. Bruen, was the only dissenter.

They based the decision on the new "History and Tradition" criteria they made up in 2022. I was listening to NPR today as they spoke to a law firm that is defending Louisiana's new law requiring the 10 Commandments in every classroom based on the same "history and tradition" criteria.

It's such a stupid fukking way to run a country. I kept wanting the host to ask whether school desegregation would fit the "history and tradition" criteria, and thus whether Brown v. Board of Education was about to be overturned. I don't think she was as on top of things as she needed to be (she was asking practical/political questions, not legal ones, as interviewers often do), but maybe she got there by the end of the interview.

Yeah, it's absolutely insane and at the same time they just throw legal precedent away in the same breath.

I wouldn't put anything past SCOTUS or the Conservative groups mounting the wave of challenges that have been taking place. If I woke up in the next few months to years and it was overturned I wouldn't be surprised. Hopefully she did most journalists have legal mind I feel...

The public really needs to wake up and get active because we're speed running to a white nationalist fascist christian theocracy and it is mainstream it's not just a militia in a bunker in the middle of nowhere, it's not the fringe of the Republican Party, and it's not an occasional few Republican congressmen from a backwater.
