I actually understand how qualified immunity works for police actions - and the "justified homicide" is a legal defense - it isn't a "type" of killing.

Justified homicide - only applies when there is a threat of imminent harm - *and* there is not an option to simply leave - every person has a "duty" to retreat if available.
It is also much harder to apply when you're breaking into someone's home and shooting at them - as opposed to a firefight outside on public property.

When applied properly by a prosecutor (either federal or state) - the "justifiable homicide" defense would have little merit.

"Firing the first shot" means nothing.

The million dollar question is: does qualified immunity supercede justified homicide
