A report was made to the college and criminal reports were filed with the police, but the D.A. has to make the decision whether or not to charge.
Rape cases tend to be the ones most ignored by police and D.A.'s both. Only 2% of reported rapists serve jail time, sometimes not even getting taken to court even when there's proven DNA evidence of stranger rapes against mulitple women unknown to each other. I'm guessing the demographics of the police force have a lot to do with that.
Either there's a mistake in the reporting or it's just another example of police/DA doing everything they possibly can to avoid charging rape accused.
I thought he might have fallen within the 3-year window in California. But he was 21 in October 2021, so if she was 17 then he's not within that 3-year window no matter when her birthdate is.
So at the very least it seems like statuatory rape is an open/shut case. Also intoxication of a minor. Maybe he has leeway if he claims she lied about her age, but I don't think it works that way. But she also has injuries, was intoxicated, the gang rape....maybe they're just trying to get their ducks in a row and figure out how many things to charge him with.
The best thing he has going with him is it being a football party and multiple teammates also being accused, so likely everyone at the party is going to be a helpful witness to the defendants.
