He told the cops in his interview that he never even saw a gun. He felt something hit his back, saw the kid make some kind of gesture, and pulled out his gun and fired.

What type of evil and sick devil you have to be to shoot and murder a young child and then clock in to work like nothing happened? There are too many guns in the country and a lot of cowards, it is shoot first ask questions after. I am against the capital punishment/penalty but this goon shouldn't be able to spend another day outside the prison cell

His exact words were that he never saw a firearm, thus he never properly identified the target or verify they were an actual threat. I never said he shot at random.

1. Why he shot without identifying the target or seeing a gun
2. Why he failed to report having been shot at
3. Why he failed to report shooting someone
4. Why he tried to go to work the next day like nothing had happened
5. Why you claimed he wasn't charged with not reporting it when it was an integral part of why they charged him with manslaughter




I know you'll throw on the cape for damn near any cop and think they're almost always right when it comes to shooting people, but I'm still waiting to hear which department you worked for.

He was shot in the back/neck and felt something wet, he made the right move under the circumstances, IMO

I agree he shouldn't have left the scene

You wouldn't admit you were wrong in the first one we argued over even when I quoted multiple gun nut websites going off about what a bad shoot it was. Or the pro-gun podcast with the lawyers going off about what a terrible shoot it looked like and how he should catch charges, before one of them finally decided two hours in that the guy should be let off on a manufactured "he could say it was a burglary" claim even though the clearly unarmed man he killed never entered his home and never intended to burglarize anything.

If you can't back down from that one, why should I argue any of the others? You've already made your position on shootings in general quite clear.
You don’t know what was going through the COs head he could’ve ran after he drawn the shot. Sounds like everything happened quick hence his reaction time, the only mistake he made was not reporting it, that could’ve been due to fear.

Ok, @King Jove you need to update the thread title. Waaay too many people are just reading your incorrect title and going from there. We have so much more information now and the thread title and the actual situation are night and day. LITERALLY!

This wasn't some 14 year old getting shot in a water balloon fight. This was a group of ADULT morons riding around at 1AM in the dark shooting pellet rifles at people.

Change the title and report the story accurately now!

There is nothing incorrect about the title. The victim was eighteen, so he was teen. He was shooting a toy gun that shoots water pellets, so it was a toy water gun. It's not my fault people can't read the story :yeshrug:. You can make your own opinions. but the title is factually correct.

Nothing good comes outta being outside at 1am around that area. I get it's her little bro who died, but "they were just having a water fight and it was 90 degrees" just ain't valid. Where was she? Probably asleep with a fan on, where that dude shoulda been at that time.

Even if he didn't have a lil pellet gun or whatever, simply being out there at that time is making yourself eligible for something bad to happen around there. It's bad enough being out there during the daytime.


I've seen those pellet guns. They're illegal, I get it, but all that shoulda came from that is confiscation. That CO is a piece of shyt and what it proves is that no officer is ever off duty. That said, why would any kid wanna ride around with those pellet guns in the hood? Inevitably they're gonna run into someone with a real gun and it's gonna end just like this.

Dion Middleton, 45, fired a single shot toward a car that allegedly killed 18-year-old Raymond Chaluisant after he felt a “stinging in his back” and saw a passenger in a car making a hand gesture, said Joey Jackson, who is the attorney for the correction officers’ union.

“I’m trying to provide context,” Jackson said in Bronx Criminal Court. “That context would suggest to the court that at the time my client discharged a single round, he was doing so under the belief that he was in immediate fear of death of his life.”

Benny Boscio, president of the Correction Officers’ Benevolent Association, defended Middleton on Friday and called the type of water pistol “an ongoing threat to public safety.”


“While this incident remains under investigation, we are aware that the media has reported a number of things which are not based in facts,” Boscio said in a statement. “Our officer fired a single shot in a situation where he felt his life was in immediate danger, particularly after feeling something hit his back.”

An NYPD traffic officer was also hit with pellets in the same vicinity, Boscio claimed.

Chaluisant, who was shot in the face as he sat in the passenger side of an Acura early Thursday, had an Orbeez water-pellet gun on him when he died.



“Let’s call it what it is, a weapon. It looks real and it’s a weapon that shoots pellets which tend to hurt,” Jackson said, implying the teen may have been taking part in a viral TikTok challenge with the Orbeez.

“This is all the rage on TikTok and I think a lot more young people are going to have significant issues in the event that they continue to use it,” Jackson told Judge Jeffrey Zimmerman.

“My client would have no reason to know how old the person was who was shooting at him at the time,” Jackson added.

“The only thing my client intended to do was have the ability to go home to his loved ones that evening and in turning around and engaging with this car, he wasn’t trying to kill anyone he was trying to protect and preserve himself.”

But Justin Siebel, a prosecutor with state Attorney General Letitia James’ office, which is prosecuting the case because a correction officer is involved, said by the correction officer’s own admission he never saw anyone holding a firearm or weapon and never heard shots fired.

“He also stated that he was not injured and he was not hurt and he was not shot,” Siebel said. “The defendant then continued walking on his regular course and did not at any point stop and call the police or inform anybody.”

“His actions show that he does not intend to and definitely did not intend to at the time take any responsibility for the fact that he had just fired a round,” Siebel added.

The judge said he believed the correction officer was a flight risk and questioned if he had thought he was hit by a shot.


“It doesn’t seem to indicate in his statement that he knew he had been shot,” Zimmerman said. “He talks about feeling a stinging. It felt like glass, but he doesn’t say I know I was shot.”
