Aaron they are not. Here is the agreement at the time as quoted by the President of ES prior to the signed contractual agreement.
We have offered the United States of America the opportunity to outsource part of its prison system. We are willing to take in only "CONVICTED" (emphasis added) criminals (including convicted U.S. citizens) into our mega-prison (CECOT) in exchange for a fee.
First off, the people sent were NEVER convicted. Second, this is dated Feb 3rd. Third in exchange for a fee. In essence every single person sent there MUST be brought back since they were never "convicted " in the US let alone and they did not receive due process. There is a fee per head. The US citizens we shall talk about later. Below are the screenshots of data from his account. Have a good read.
