What if Black Jesus isn't there physically, and whenever characters are talking to Him they're just praying in their heads?
Then that means they're coming up with all these schemes and plots on their own, then with Black Jesus criticizes them for things its really their own conscience.
That would answer the question of why Jesus would hang out with people actively committing crimes without forcing them to stop: Because in real life even criminals pray. Or when he put the "curse" on Dianne, it's just in her own mind.
