Thing is, if Scumling tries to fight a forced sale in courts, that shyt will go to arbitration. So the recording will still be admissible in arbitration. He can only go after the chick in a separate lawsuit.

I don't know the contours of the NBA arbitration agreement, but arbitrators have wide latitude in how they do things. I would never make a sure bet on that. As far as the tapes go, just because it cannot be used against him legally, it does not mean that the owners cannot bring it up. There is nowhere in the constitution that they say that the evidence is only evidence that would be otherwise permissible in court. He lost, plain and simple.
