lots of reasons.. i posted on this a while ago. there is a reason that abuse/genocide starts with the hidden and progresses to the explicit along a path of ever decreasing social limits on behaviour. through repetition, example and group acceptance behaviour shifts from non-norm to normative.

I’m not concerned with hypotheticals, usually drawn up by cac academics, about the transition from hidden racism to genocide. Black history in this country speaks to our unique capacity to overcome a system of genocide. This idea that black people can’t successfully confront genocidal ambitions has no precedent and is in fact at odds with history. Show me how the current post-racial illusion we now live in has been kinder to our struggle. All it’s done, in my view, is made us complacent and unwilling to have a reckoning with our place in this country.

I believe the same kind of hate speech laws implemented in Germany would be appropriate here. I think the kind of racism expressed by this woman should not be tolerated by an academic of any standing, and would like to see her removed from her position at Penn. That we even have an opportunity to effect her removal is precisely because she’s been open with her views. Would you have rather she kept these views to herself while teaching law in lectures whose attendance included black law students?
