looking through twitter now and man these conservatives despise roberts

this supreme court has moved so far to the right that they think this former rehnquist staffer, reagan justice department lifelong conservative is now RINO dead weight holding them back
They want a USR. A United States for Republicans and anyone who disagrees should leave. They want full on authoritarianism as long as they're in power and scream about the Constitution when they're not. The Democratic party allowed this monster to be built and take hold by not focusing on the courts wrt to the Federalist society and no Democratic party talking points media to counter fox news. It's madness. They legit think the GOP will work with them time and again. Conservatives aren't conservatives. They're fascist in 2020.

It is time — past time — to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues, and mosques,” Justice Gorsuch wrote.

:ehh:
He's Right. Still it's :pacspit: him

Just skimmed the article, but if Cuomo opened bike shops and other establishments without the same restrictions as Gorsuch suggest, he shot himself in the foot.
:manny:Apply the laws equally(to cacs) or you will lose in court.

Bike shops aren't the gathering of dozens or hundreds of people daily or weekly for services.

:gucci:

You can control entry and social distancing in a bike shop. And folks aren't sat down for an hour or more in sickly circulating air.

:gucci:

NY did well to get this virus under control, now it has to contend with this batshyt crazy religious community hosting super spreaders every week.

The court’s order addressed two applications: one filed by the Roman Catholic Diocese of Brooklyn, the other by two synagogues, an Orthodox Jewish organization and two individuals. The applications both said Mr. Cuomo’s restrictions violated constitutional protections for the free exercise of religion, and the one from the synagogues added that Mr. Cuomo had “singled out a particular religion for blame and retribution for an uptick in a societywide pandemic.

Reminds me of the muslim ban...:francis:If true, soon as you single out a religion, you are doomed in court.

In a letter to the court last Thursday, Barbara D. Underwood, New York’s solicitor general, said that revisions to the color-coded zones effective Friday meant that “none of the diocese’s churches will be affected by the gathering-size limits it seeks to enjoin.” The next day, she told the court that the two synagogues were also no longer subject to the challenged restrictions.

NY fell back on their own, which suggest they new they made a misstep somewhere.

:yeshrug:Just be even handed and lock it all down. Especially if you plan to infringe on amendments.

Hogwash. Religions like to look for persecution where there is none.

It would be one thing if they killed out there groups but they will be mingling and infected innocent people in public.

Keeping my overhead low, and my understand high
Churches are shut cause it's a lot of idiots with their mouths open spreading Rona in there typically for long periods of time.

In a store, most people are in and out and not conversing. It's the same reason bars and restaurants get closed.

Now, I'd be fine with limiting them to 50% capacity max, adhering to social distancing, and requiring masks.

If they fail at that, they should be shut for violation.

So ban all guns and not just assault rifles?

So all drugs are a go and not just marijuana?

From a law professor who isn’t a psychopath:
The Supreme Court’s modern rule is that religious groups have no right to any special exemptions from laws of general applicability. Under this rule, the free exercise clause of the 1st amendment protects those groups from being singled out for harsher treatment than other similar but non-religious groups.

So if A and B are the same, A and B have to be treated the same.

But if A and B are different, it’s OK to treat A differently than B, even if A is a religious group and B isn’t.

But how can you figure out if A and B are sufficiently different to apply this test correctly?

“You’d have to be deliberately distorting it to miss the point this badly.” Sounds about right.

yeah the EO banned a lot of secular gatherings like salons, gyms, restaurants, schools

No. 202.68: Continuing Temporary Suspension and Modification of Laws Relating to the Disaster Emergency

makes perfect sense that it wouldnt apply to liquor stores or bike shops because you just go in to buy something rather than staying around for a prolonged period of time with other people
