No ur wrong ..go to sleepYeah I was just reading this story. It sounds like potentially they will get off and if not, 1st degree murder is NOT happening.
If the defense can say that they chased him (he was caught on camera in the house being built) after suspicions of theft, then a scuffle broke out and they feared for their life, then I don't think the jury will throw the book at them let alone convict them. Video evidence is of course there, but reasonable doubt and all that.

None of this justifies death of course, not in the slightest... but I don't see this one working out well in the court

Who knows though, it’s definitely not murder 1 though, no premeditation - the biggest issue.
The law is clear. You cannot use lethal force to defend property you do not own. You cannot even perform a citizens arrest for property crime you do not own. They are toast.
I hope they are but I’m just trying to see HOW the courts would throw this out.
Again, defence lawyer may then say they were making a citizens arrest and during the scuffle it because potentially life threatening.
After driving away I don’t think they can say they were defending property that they weren’t on.
Again, I’m seeing this from the 50/50 legal aspect.
you didnt read anything then.. they had a prior confrontation less than 2 weeks before..I genuinely hope I am but that’s how I think the courts will see it.

if its proven they met 12 days before and had an altercation..words of the killers...and one of them works in the same building as him as reported... tehy are toast.. murder 1As far as trespassing goes:
To be eligible to make a citizen's arrest for a crime on or in relation to property, you must be one of the following:
You can not chase down people who you suspect committed a crime and hold them at gun point, that is illegal detention.
- the owner of the property;
- in lawful possession of the property; or.
- have been authorized by the owner or the person in lawful possession of the property.
If you are involved in a crime (illegal detention) that results in someones death you can be charged with murder. At the very least these men's foolish actions resulted in manslaughter.
They should rot IMO.
