There needs to be a court challenge to Georgia's "citizens arrest" law.
Anything short of observing someone committ an actual crime (e.g. burglary or criminal trespass) and a an attempted citizens arrest leads to an innocent individual suffering bodily or mental injury or death should lead to an immediate charge of criminally negligent homicide or assault that carries a minimum sentence of 10 years for assault and 25 to life for homicide. It should override any affirmative defense such as self defense.
You just cant create the situation and end up killing an innocent person when u feel ur life is in danger.
We are all taxpayers that pay the police to investigate and we defer those duties to investigate to law enforcement. Hell no im not stopping and being detained by any people who do not identify themselves as police especially chasing me in a pickup truck with shotguns, even police officers make me nervous in these situations but I am more inclined to stop for them then some complete stranger.
This is an equal protection under the law issue really and this is why voting and federal, state and local elections and judicial appointments matter so much to our people. All these stand your ground laws or citizen arrest laws are just bad law.
This is the shyt that happens when we dont care to vote in mass. U gonna have conservative federal and state officials write these archaic laws and have conservative state and federal judges uphold these laws. These laws just puts u and ur children and children's children in danger.
I dont know if Georgia has a stand your ground law but if they do I guarantee you that they get off in Georgia in a criminal jury trial due to Georgia's stand your ground law..... the struggle that ensued when he attempted to get away from them and then take the shotgun away is enough for them to get off based on how their laws are written. This is Trayvon Martin all over again.
