Women tend to get custody (it's something like 80% of the time) because women tend to do most of the caregiving duties that are considered when assessing "the best interest of the child."

It's true that for years it was nearly a given that women would get custody, but legally this isn't the case anymore.

It's not so much that men can't do the duties that women do. It's simply that statistically, they don't.

how is this generally true? pretty much all of my friends who are fathers adore their kids and would do pretty much everything for them. as far as mothers go on the other hand, two of them are ratchet. one left her man and her kid to go and live with some other dude not even a year after her son was born. the other spends her days smoking, talking on the phone and on facebook while she parks her kids in front of the tv and yells and them when they are not being quite. now, i know this is not a representative sample, but it has in fact led me to assume that fathers are the more nurturing and responsible parents.

Goes back to women being more emotional creatures and men the more logical thinkers.

Long story short, emotional = coddling which the courts often believe a young child needs. Like I said I don't think it at all makes one a better parent than the other, it's just the logical fallacy the mother is more nurturing and that's what's better for the child. :manny:
