in a lawsuit, damages (aka the $$$ u get), cant be speculative. something like "brand dilution" and the embarrassment to his street cred etc. is a highly speculative damage, and not calculatable. from my understanding of it, its pretty much baseless.
for wat its worth. im a cali lawyer tho, iono how it is in new york, but i'd understand its the same.
