The decision is a defeat to Holmes’ defense team, which since August has sought to keep the prosecution and other witnesses from learning the contents of the notebook, which reportedly contain violent imagery and detailed descriptions of the attack. Fenton never received the package, and it has since been sealed. Law enforcement officials thumbed through the notebook in the University of Colorado’s mail room days after the attack. But because the court ruled last fall that Holmes was under Fenton’s psychiatric care at the time, lawyers and witnesses couldn’t discuss or see the notebook’s contents.
Insanity
You simply cannot orchestrate and execute that level of planning in insanity. Dude is just evil, give him that injection and keep it moving
I would, if on the jury, would not accept the not guilty plea. He had premeditated the murders. Purposely wore a bullet proof vest. Purposely set bomb traps at his apartment. His mental capacity was clear as he drove to the cinema and obeyed traffic laws, parked, got out, wore a disguise, steathly entered the theater, waited until a certain time in the movie instead of just entering and shooting, took a tactical position so he could not be stopped, he also aimed, fired and reloaded his weapon. When he exited the theater, his mind was clear enough to understand police orders and he obeyed them.
After a judge allowed Aurora, Colo., shooting suspect James Holmes to plead not guilty by reason of insanity on Tuesday, he dealt a major setback to the defense by granting the prosecution access to a key piece of evidence.
