I'm not saying breh is innocent of the original charge.....but the line of thinking does make sense.

If you're maintaining your innocence (or that you were that your sentencing wasn't warranted compared to the act convicted on)........and you shouldn't even have been in prison in the first place, but now you've done something "awful" due to conforming to the prison lifestyle.....I can see the logic behind it basing an appeal around that.

Procedurally it doesn’t make any sense at all. They’re long past the appeals stage. If they’re filing a habeas petition based on actual innocence, it doesn’t matter if they’re on death row or not, the standard of review is the exact same. Theres a minor argument about counsel by right, and they may lose those lawyers, but I can see someone taking it up pro bono.

:patrice:i don't know.. plenty of men have done their bid without stomping a fellow inmate to death. Fighting is one thing but getting a body.... I'm no legal expert but i would have taken that Biden clemency

Your honor, I didn't kill the first guy but i did kill the second guy BUT if i wasn't in prison i wouldn't have killed the second guy so ... :mjgrin:

There is no other way that he could spin this either we he is still fukked

Oh they guilty AF. And they killed other black people that tried to file a report on crooked black cops. I just watched a youtube video about the Caliope projects in New Orleans documentary from the 70s - 90s. They brought up this case

They are looking for technicalities to throw the entire case.

He's Not so much seeking evidence of ' "i didn't do it", but moreso looking for evidence of "i didnt get the right legal aide at the time" or " this paperwork was filed incorrectly by the prosecutor". These death row cases last so long partly because of appeals, and theyd lose their privlege to do so.


I fell into a rabbit hole and looked up the other death row cases in Louisiana and a few of them have stalled for decades while grasping at straws like this. For example, the other dirty cop has been on death row since 1995 because their lawyers discovered that the prosecutor failed to follow procedure for psych evaluations 2 decades ago.


Personally, i think this system of decades long appeals is a racket by the lawyers who get to bill infinite hours to the state from naive prisoners who think they still have a chance.:hubie:
