If Bernie went around campaigning for a bill in a municipality that he couldn't vote in you wouldn't give him this same excuse. As has been pointed Bernie voted for the crime bill, but unlike Hillary, he spoke out against it and voted for it not specifically for its tough on crime provisions, but because:
