Trump will at some point suggest pushing back election due to coronavirus (Louisiana vote postponed)

Delaying a state primary is a state issue. Stop conflating this with the federal, constitutional issue of a general election.

Breh...I'm only going to say this once. Stop looking at things in a vacuum. Stop thinking that "norms" or even the Constitution is a deterrent. More importantly, stop looking at events so narrowly. This is about looking at the political environment. Anything out of the ordinary, even something as seemingly inconsequential as the Democratic Primary in a state that Dems have no chance of winning, helps to fuel the sense of uneasiness, confusion etc that trump depends on. Do you honestly think Louisiana is the only state that will do this? Now that they've done it, I guarantee you right this minute there are probably another 10 states convening relevant agencies etc, trying to determine whether they should follow suit. THINK.

This is a bad take. For all the fukkery Trump has done, there’s usually some (flimsy or fringe) legal reasoning behind it. It’ll turn on an interpretation of a statute or some vague undefined power. Ain’t shyt vague about presidential elections on the first Tuesday every 4 years. There’s nothing in Article II that even hints that it’s possible to suspend elections.

The only thing comparable was Lincoln suspending habeas corpus at the beginning of the Civil War. And the court held that he couldn’t do it. Albeit, after the fact.

Put simply, it is perfectly constitutional for a state legislature to scrap statewide elections for president and appoint electors itself. It would also be constitutional for a state legislature to disregard the winner of the statewide vote and assign electors to the loser. And because the Constitution grants legislatures the authority to pick electors this way, Congress cannot stop them.

Due in part to partisan gerrymandering, Republicans control the legislatures of 28 states. Collectively, these states have 294 electoral votes. Trump himself could not cancel the entire presidential election. But he could ask these GOP-dominated legislatures to cancel their statewide presidential elections and assign their electors to him. It’s doubtful that we will face this situation in November. But imagine a worst-case scenario: The election is approaching, and the coronavirus remains rampant in our communities. States are unsure whether they have the personnel and resources to hold an election. Congress has failed to mandate no-excuse absentee balloting, and many states have declined to implement it. Or the postal service is so hard hit that it cannot reliably carry ballots to and from voters’ residences. It’s not difficult to envision Trump’s allies in state legislatures assigning their states’ electoral votes to the president, insisting that these dire circumstances justify pulling a constitutional fire alarm

not only that but his people are exactly the same, sometimes even worse. There will absolutely be ppl in certain states that will try and play those games, even if he publicly says he doesn’t support it (yet)
