His lawyers really dropped the ball, getting that taped reintroduced into evidence was a huge mistake that they should have seen coming with their line of questioning.

They also did a disservice by not allowing the drive and bodyguard not testifying. They got too cocky for their own goods.

is it intentionally shooting her or intentionally discharging the firearm?

because intentionally discharging in public is just like if i went and fired a shot at the ground or something that wasn't directed in a way that can harm anyone else, negligence is basically when it was fired off in public and could also cause harm to another person. so you could technically have both.
