if you mean pursuing legal action, Mal did say in the response he'd never take a "friend" to court like that, regardless if they fell out. That might be a reason they really haven't moved with that and just cut their losses.

It works both ways too...why hasn't Joe pursued legal action? He claimed in the firing episode if they tried making a podcast it was a breach of contract and he could sue.
