iCloud doesn't store your songs. You have to sign for iTunes Match I believe.

My point is that my phone is restored from iCloud but iTunes keeps trying to force me to set up my phone as a new phone or restore from backup on my pc

No, nothing is official but im willing to bet $$$ those dates are 70% accurate. Only reason it isnt 90 or 100% obviously is that there is always room for manufacturing error etc

it wsa actually really simple to restore my phone from icloud, and syncing the music was easy all i had to do was click "set up as new iPhone".
