The problem with the 40 acres and a mule, from a legal perspective, is that the General who made the pronouncement, wasn't authorized to do so. Maybe if we lived in a country where there is no civilian control of the military, his pronouncement might hold. Second, it was a gratious promise, which don't create contracts. Third, real estate dealings must be evidenced by writing, under the Statue of Fraud. Don't get me wrong, I would like to have some form of reparations for what my ancestors endured. But who should be held accountable? The American government, or the British government, or should the African states which exost today be held accountable, due to their ancestors selling our ancestors to the Portguese, or English?
