its based on the time of the crime obviously. plus, of all the murders it's probably only 1% of people that get a death penalty. its sounds weird but i don't think this case is that aggravating (legally) even if he was an adult

edit: fukk that im not going back and forth about something that can be easily googled. you are confusing the terms. being tried/charged as an adult is not the same legal concept as the age requirement for the death penalty. its different legalities
