you know what the dems need to do? openly make the threat to pack the court if mitch goes back on his own words from 2016. say that if mcconnell doesnt follow his own rules, then they dont care about them either

its the only play i see. let mitch put a judge on, knowing he'll be signing onto packing the court

Before this thread gets any longer, I just want to point out, again, that RBG had 1 black law clerk her entire legal career and refused to let Obama appoint her successor.

Do with that what you will.

Ginsburg, on the other hand, has hired only one African American law clerk in her 25 years on the Supreme Court. This is an improvement from her 13-year tenure on the U.S. Court of Appeals for the District of Columbia Circuit, when Ginsburg never had any black clerks. When this issue was raised during her Supreme Court confirmation hearings in 1993, Ginsburg said: “If you confirm me for this job, my attractiveness to black candidates is going to improve.” This remains a promise unfulfilled.

The calls for Ginsburg to step down began in 2011 when Randall Kennedy, a Harvard law professor and former clerk to the late Thurgood Marshall, wrote a piece in The New Republic gently urging Ginsburg, then 78, to retire while Obama was in office. (He had suggested the same of Justice Stephen Breyer, now 80.) Kennedy was publicly airing private concerns among Democrats that it could be Ginsburg’s last chance to be replaced by a Democrat.

"Who do you think President Obama could appoint at this very day, given the boundaries that we have? If I resign any time this year, he could not successfully appoint anyone I would like to see in the court," she said. "[The Senate Republicans] took off the filibuster for lower federal court appointments, but it remains for this court. So anybody who thinks that if I step down, Obama could appoint someone like me, they’re misguided."

yo, i'm not tripping about her passing away, she was 87 and sick as a dog... i'm tripping she couldn't hang on till january....

If R’s force this and it goes through the and Dems win The WH+Senate they absolutely have to expand the court.
They probably aren’t going to appoint her replacement until close to the election. As a boon to these vulnerable Senate candidates. But again, Dem voters and people who disapprove of Trump are fired up.

My gut says they do it in the lame duck. And if the Dems win the WH and Senate you will see Alito and/Thomas retire and be replaced by some 45 year old lunatic.
