This isn't about legislation. It's about judicial nominees. They don't want Obama to fill crucial federal judicial positions, particularly the DC court which is considered the second most influential court aside from the SCOTUS.

Well he shouldn't from a technical standpoint but it doesn't matter Obama's support amongst his own party is iffy at best, just based on the fact that he left hanging in the wind on this Healthcare Act.

Pres O will probably be trying to fill all his appointments before the election. GOP has an upper hand in taking the senate in 2014 (most of the Dem seats up for elections are in red states) but they won't be able to abuse any rules until 2016, assuming they even manage to win the presidency.

And yes, Hillary is beatable in 2016, depending on GOP candidate.
