Now, nearly two weeks after the shooting, the video is at the center of a new discussion: news outlets are being asked for a $10,000 fee if they wish to share the video.

The New York Times reports that a publicist representing Santana has begun sending out cease-and-desist letters to news oulets around the world, demanding that they either pay a $10,000 usage fee for the video or stop showing it entirely.

The New York Daily News reports that the $10,000 figure isn’t fixed, but may vary depending on the outlet — some will be charged more, some will be charged less.

Of course. Didn't someone in this thread call that shyt happening lol. I will be surprised if dude does any hard time. Hell those teachers down in GA will probably do more time then him, when all is said and done.

Smart move of the prosecutors part. No jury of his "peers" will convict him knowing he could potentially be killed by the state. Additionally, that would set precedent and would turn the justice system on its head.

By case law, and president that has already been set, premeditation can be as little as seconds.

I know this is Nebraska, but its a typical litmus in most states.

No particular length of time for premeditation is required, provided that the intent to kill is formed before the act is committed and not simultaneously with the act that caused the death. The time required to establish premeditation may be of the shortest possible duration and may be so short that it is instantaneous, and the design or purpose to kill may be formed upon premeditation and deliberation at any moment before the homicide is committed. State v. Robinson, 272 Neb. 582, 724 N.W.2d 35 (2006).

The term "premeditated" means to have formed a design to commit an act before it is done. One kills with premeditated malice if, before the act causing the death occurs, one has formed the intent or determined to kill the victim without legal justification. State v. Robinson, 272 Neb. 582, 724 N.W.2d 35 (2006).
