Easy, even an independent can purchase a mechanical license to use a sample and post it on iTunes. Expensive for the average Joe, but she has enough bread to pull it off.

Or she can agree with Copyright owner directly and share the profits without licensing fees...

Edit - or am I giving them too much credit here?
